FINALLY. Dreeben explaining that Trump is not being prosecuted for official acts. Anything that could plausibly be characterized as an official act would be used for its evidentiary value re motive and intent for an illegal conspiracy in his capacity as a candidate for office, not as president
@AshaRangappa_ Justice Jackson had to clarify what Alito, Kavanaugh, Gorsuch and Thomas have been trying to put up a smoke screen on. The courts will decide in trial what is an official act or a campaign(personal)act. They can't say that the SC didn't clarify the difference. Awesome!
@AshaRangappa_ Disagree--I think some of the DOJ-related acts are arguably official (under Nixon v. Fitzgerald standard) and I don't think Dreeben was saying otherwise (he was talking if Smith decides not to prosecute the official acts to speed things along). /1
@AshaRangappa_ @dcboyisangry It’s the analogy of the attorney client privilege being pierced due to a crime fraud exemption?!
@AshaRangappa_ Planet Earth to SCOTUS: Last time I checked, sabotaging elections and staging coups are not official presidential acts.
@AshaRangappa_ So SCOTUS will send the case back to determine what are "official acts". Lower court makes a ruling. Trump appeals back to SCOTUS. Game over, delay a complete success. 😡
@AshaRangappa_ @PatMalo28822361 There is NEVER an official reason to stage a coup.
@AshaRangappa_ No. Trump is being prosecuted on a nothing burger. Nobody “organized” anything. He never incited violence like Maxine Waters, Talib and all of the other losers who cheered during the 2020 riots and murders. He was never found guilty of doing anything. But NY wants blood anyway.
@AshaRangappa_ That was a really interesting exchange!
