The 7 day period begins today for the @GovRonDeSantis to review carefully SB 360 and hopefully veto. SB 360 was signed by officers and presented to the Governor today, 4/13/23.

Lastly, we simply need to practice open debate and hearing all sides. It’s very strange @Johnfsnyder is not responding to discussion requests on SB 360. He sponsored it. I’ve been writing him & @ABCofFL since 3/13/23. I’m not the only one being dismissed @VictoriaCBS12

In this case, condo owners and Associations would have either ZERO or very little time (1-3 years) to file any legitimate construction defect claims after turnover. What used to be 15 years, then 10 years, is not even 7 years. SB 360 means it’s 3 years max Boards have to file.

They could theoretically sell 89% of all units or less, & intentionally stop all sales to allow the 7 year repose lapse after “whichever date is earliest” which USED to say “latest”, a HUGE change in law. Or the developer could use the majority of the 7 years, i.e. 5-6 years.

Most developers will sell more than 90% of units well before 7 years, which triggers turnover. The key here to clarify in your report @VictoriaCBS12 and @beckerpoliakoff Patrick Howell’s comments is SB 360 now allows for a stall option if developers so choose.

Thank you @VictoriaCBS12 for bringing light to this very damaging bill for condominium associations. @Johnfsnyder is also not responding to me at all, as you say in your report. There is a reason for that. All rests on @GovRonDeSantis now to do the right thing and veto.

The repose used to be 15 years; was cut to 10 years in 2006, and now is cut to 7 years once signed into law, which actually isn't even 7 years due to the change in language from "latest" to "earlier." It's more like 2-3 years max. This is a very big deal.

@GovRonDeSantis I sincerely do not believe the majority of FL senate and house members who voted to approve SB 360 are actually aware how detrimental this bill will be. They likely just approved along party lines by logical influence from developer and construction lobbyists. @Johnfsnyder…
