Mr Hammond has been misled by HMRC briefing. As he was told, NC31 follows rather than sets precedent. As he later admits "maybe [he is] wrong". He is wrong.

Some confusion in the debate (presumably caused by the misleading briefing). NC31 does not & cannot set any precedent as all it does is RESTORE basic taxpayers’ rights & puts the situation BACK where it was. It’s the #LoanCharge that set a precedent & a dangerous one!

Now @DavidDavisMP is introducing #NC31 in the #FinanceBill including pointing out that the Government have issued a misleading briefing. Says that the principle of innocent until proven guilty must be restored in the tax system.

I've been listening to Parliament over the past 30 minutes or so. It is so encouraging that so many hon members are critical of excessive state powers and the removal of the rule of law. If they feel so able to lecture China they presumably see that the UK should set an example.

If I were an MP and I were faced with a choice: 1) focus on my short-term career prospects or 2) do the right thing, even if it means defying a whip, I would see how I might be judged by history. If I were an MP today, I would unhesitatingly vote for NC31.

I’m no longer effected by the loan charge, but I can’t feel happy and relieved.. instead I just feel numb because others are still suffering. It’s because of the others it’s over for me and that’s why I’m STILL going to continue fighting. @LCAG_2019
