Award set aside under s67 #Arbitration Act 1996 after re-hearing. D suffered losses after explosion on vessel carrying "unprocessed incinerator bottom ash"! Tribunal had no jurisdiction. No arb. agreement between D & C (which was not the shipper) @BAILII bit.ly/3dER1yR

No costs awarded against arbitrator (X) who resigned after C applied to remove under s24 #Arbitration Act 1996 but before application decided. X resigned but not because they conceded C's claim of bias. C was not 'successful party' under CPR r44.2 @BAILII bit.ly/3e4q737
