Propensity evidence is prohibited in nearly every state, and for good reason. It’s extremely prejudicial. The trial court judge should never have let that evidence in, but he did and now here we are.
@LissaJoStewart Not sure the Cosntitution had anything to do with this one tbh
@LissaJoStewart As a fellow attorney, I agree that propensity evidence can not be used at trial. But. It does our profession no good to explain why in the most condescending way possible.
@LissaJoStewart This. Dude needs to be in prison forever, but not via super duper prejudicial evidence. There’s enough evidence to have a proper prosecution and conviction.
@LissaJoStewart We can all hate HW, but that judge let in testimony that never would have been allowed if he wasn’t the villain of multiple media pieces. Glad LA convicted him so he isn’t out on appeal.
@LissaJoStewart This exchange from A Man For All Seasons sums it up quite well
@LissaJoStewart Umm. It’s good when the 404b standard is raised, actually.
@LissaJoStewart So does this mean it’s a mistrial? (Sorry I’m just not sure what this means or what happens now because of this. Surely not an acquittal?)
