Former veteran Toronto police inspector Hank Idsinga just confirmed to @gregbradyTO on air that the wearing of a series of smoke canisters at a protest does warrant arrest for breach of the peace.
Except that a Breach of the Peace does not bring with it any penalty. It is just arrest and removal from situation then release. How about Posession of a weapon for a purpose dangerous to the public peace? (Or imitation thereof) Sec. 88 (1) CCC. if charged by indictment carries a penalty of ten years in prison.
